HABITAT POLICIES
Terms of service
Draft updated: 29 October 2026
Who operates Habitat
Habitat is operated by William John Versfeld, a sole proprietor trading as HabitatZA, 12 Parkmore Place, Monument, Gauteng, South Africa.
Privacy, support and billing enquiries: jannie@volton.co.za.
1. Using Habitat
These terms describe your use of Habitat, together with our privacy notice and billing policy. Please read them before creating an account or purchasing a plan. Mandatory rights under applicable law remain unaffected. Habitat is intended for adults aged 18 or older using the service for authorised property marketing.
2. What the service does
Habitat helps individual estate agents turn property information and photographs they supply or import into agent-branded flyers, three story images and social captions. You review the facts and copy, then download, print or share the pack yourself. Habitat does not automatically publish adverts, send WhatsApp messages or buy advertising on your behalf.
Habitat is not an estate agency, property portal, broker or property valuation service. It is not affiliated with Property24, any other portal or any estate agency. We do not guarantee enquiries, leads, viewings, sales or any particular commercial result.
3. Your account and brand profile
Provide accurate account, contact and brand information, keep your sign-in secure and notify us of suspected unauthorised access. Complete the required brand profile before creating a campaign. You remain responsible for activity you authorise through your account and for keeping your advertised contact details current.
4. Your first test-drive campaign
A new verified account may create one successful campaign using its own listing before subscribing. Its finished flyer and story images are displayed without an overlay at reduced screen resolution. Full-size previews, downloads, sharing, printing and campaign copy remain locked until subscription activation. Creating another campaign requires an active subscription and an available campaign credit. Screenshots and copying of on-screen images cannot be completely prevented.
Once the first subscription payment is verified, that same saved pack is unlocked and uses one included campaign credit. It is not an extra bonus credit: a five-credit plan has four credits remaining after the preview is unlocked. Failed generation attempts do not use the successful-preview allowance, although retry, capacity and abuse limits apply.
5. Paid access and campaign credits
Except for the test drive, creating campaigns and accessing saved campaign packs requires current paid access. One credit is used for a new successfully saved campaign. Repeated downloads, prints and shares of an existing pack do not consume more credits while your paid access is current. Running out of credits does not by itself remove access to saved packs.
Monthly renewal, top-up expiry, cancellation, payment confirmation and refund requests are explained in the billing policy. The price and allowance agreed at checkout apply to that purchase; the service does not silently replace those promises with a later advertised offer.
6. Your content and permission to market
- You must have authority to market the property and permission to use its photographs, listing information, agency name, portrait, logo and other supplied material. A publicly accessible listing does not automatically give permission to reuse its content.
- You retain your rights in your supplied content. You grant the operator and relevant service providers permission to store, process, format and deliver it as needed to provide Habitat.
- Habitat's name, software and original platform design remain the property of their respective owners. AI-generated material may not be unique, and no promise of exclusive copyright is made.
7. Review AI-assisted work before sharing
AI can make mistakes, omit context or produce unsuitable wording. Check prices, locations, dimensions, property features, spelling, images and contact details before publishing. Generated copy is not legal, financial, valuation or regulatory advice. You are responsible for ensuring your final advert is accurate, lawful and not misleading.
8. Responsible use and direct marketing
Do not use Habitat for fraudulent listings, impersonation, unlawful discrimination, copyright infringement, harassment, malware or attempts to bypass access, payment or credit controls. Do not use listing import to bypass another site's access restrictions or permissions.
Only contact people where you have a lawful basis to do so, including consent where required under POPIA and applicable marketing rules. Having a client list does not by itself establish permission for every marketing message. Provide and honour appropriate opt-out requests. Habitat does not send the messages for you.
9. Expired access, suspension and account closure
If paid access expires, saved campaigns are retained but locked until payment is verified. Cancellation of renewal does not end time already paid for. Access may also be restricted where reasonably necessary to address suspected abuse, security risks or unlawful use.
You may request account closure by contacting jannie@volton.co.za. Cancelling a subscription and deleting an account are different requests. We will address personal-data deletion under the privacy notice, subject to records that must lawfully be retained. Do not assume Habitat is a permanent backup of your marketing material.
10. Availability and responsibility
We aim to provide a reliable service, but interruptions, maintenance and third-party failures can occur. No uninterrupted availability or particular AI result is guaranteed. Please contact us about defective or unavailable paid services so we can investigate and address any remedy required by law.
To the extent permitted by applicable law, we do not accept liability for indirect or consequential business losses. Nothing in these terms excludes liability that cannot lawfully be excluded, or limits mandatory consumer protections.
11. Changes, complaints and applicable law
We may update these terms as the service changes. Material changes will be brought to users' attention through an appropriate notice before they apply where practicable or legally required. Published updates do not remove rights already accrued or retrospectively change an agreed purchase.
These terms are intended for Habitat's South African service and are governed by South African law, subject to any mandatory protections that apply. Send complaints to jannie@volton.co.za with enough information for us to investigate; do not send passwords, card details or API credentials. Your right to approach a competent regulator, court or other dispute-resolution body remains unaffected.
